As set forth in the\ngovernment's submission, the non-prosecution agreement does not\npreclude this prosecution.\n\nAnd even if that agreement were applicable to this\ndistrict, which it is not, the defense itself acknowledges that\nthe indictment included evidence beyond the initial\ninvestigation. That effectively moots this issue for the bail\nargument. This case will go forward.\n\nThe defendant will lose any argument about due\nprocess. He will lose any argument about pre-indictment delay.\nAnd if he choses to be tried before a jury of his peers, we are\nconfident he will be convicted.\n\nThe Court should ensure he is here when that time\ncomes by ordering his detention.\n\nTHE COURT: Counsel.\n\nMR.
