WEINBERG: It was, to my recollection, a legal\n7\nissue about whether or not the premise for a classification\n8\ndecision should be the offense of conviction which would have\n9\nbeen consistent with a tier 1 or the overall investigation as\n10\nreflected by a probable cause affidavit that ultimately six\n11\njudges, the five on the appellate division and one on the\n12\nSupreme Court, believed was the appropriate barometer of sex\n13\noffender registration.\n14\nWhat's important is that Mr. Epstein has complied with\n15\nthe registration imperatives of each state of his residence.\n16\nHe's got the unusual circumstance of having multiple\n17\nresidences.\n18\nHis principal residence is the Virgin Islands which\n19\nhas him at a tier 1 or the lowest level of classification. New\n20\nMexico he tried to register, and my understanding is that they\n21\nsaid that his nexus to the state did not require further\n22\nregistration because his travels, his daily occurrences, were\n23\nbeing monitored by his principal residences.\n24\nTHE COURT: That goes back to the question I have, but\n25\nbefore I get there, we've gone far along.
