EVERDELL: Yes, please.\n4 Your Honor, the defense moves at this time for a\n5 judgment of acquittal under Rule 29(a) on the grounds that the\n6 evidence elicited by the government in its case-in-chief is\n7 insufficient to establish each element of the offenses charged\n8 in the S2 indictment beyond a reasonable doubt.\n9 THE COURT: Move as to all counts?\n10 MR. EVERDELL: Move as to all counts, your Honor.\n11 THE COURT: Go ahead.\n12 MR. EVERDELL: Your Honor, we do make this application\n13 with respect to every count in the S2 indictment; but for\n14 purposes of today, I'm going to confine my comments to address\n15 specifically Counts One and Two.\n16 THE COURT: Okay.\n17 MR.
