The relevant statute for Count Six is Title 18, United States Code, Section 1591, which provides, in pertinent part, that: \"Whoever knowingly, in or affecting interstate commerce, recruits, entices, harbors, transports, provides, or obtains by any means a person, knowing that the person has not attained the age of 18 years and will be caused to engage in a commercial sex act\" is guilty of a crime. Instruction No. 25. Count Six. Sex trafficking of an individual under the age of 18. The elements. To find the defendant guilty of Count Six, the government must prove each of the following four elements beyond a reasonable doubt: First, the defendant knowingly recruited, enticed, harbored, transported, provided, or obtained a person. Second, the defendant knew that the person was under the age of 18 years. Third, the defendant knew that the person would be caused to engage in a commercial sex act.
